在中国，同志可以代孕吗？
<p style="margin-bottom: 20px; line-height: 2em;"><strong><span style="font-size: 20px;">中国禁止同志寻找代理孕母代孕生子，夫夫求子路艰辛</span></strong></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;"> </span><span style="font-size: 16px;">代孕的法律规定是完全禁止，我国法律明确规定，不得以任何形式买卖精子卵子、受精卵及胚胎。一旦被发现是要被依法处以相应的刑罚的。在《人类辅助生殖技术管理办法》中也提出了，医疗机构和医护人员不能为他人实施任何的代孕技术，若出现违法行为的，则要被处警告与</span><span style="font-size: 16px;">3万元以下的罚款。间接将单身者、同性伴侣排除在外。因此若想以人工生殖的方式求子，同志伴侣只能远赴海外圆梦，且男同志需要付出的成本，远多于女同志伴侣。</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;"></span></p><p style="margin-bottom: 20px; line-height: 2em;"><strong><span style="font-size: 16px;">海外人工生殖成选项之一价格却令人却步</span></strong></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;">2021年5月，台湾知名音乐制作人陈镇川透过海外代孕喜获麟儿，引发外界对海外人工生殖的好奇。</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;">2021年1月18日，郑爽男友爆出郑爽美国代孕两孩子后弃养，引发舆论大讨论。代孕一直是中国法律的灰色地带。</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;">目前美国与加拿大已经开放商业代孕，又是同志友善国家，是多数同志伴侣的首选，女同志代孕费用大致在18至25万人民币，男同志则需要100万人民币以上，原因在于男同志需要第三方代理孕母和供卵人的协助。</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;">可以说男同志花费代孕的钱几乎可以在国内二线城市买一套房子了。</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;">从代孕中介口中得知，男同志伴侣海外代孕流程至少需要两年以上，中途也常因签证问题、寻找合适的供卵人或代理孕母等原因，拉长整个代孕周期。</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;">美国代孕需要很长的周期和复杂的流程，并且费用让人望而却步，很多同志家庭转而选择到费用较低廉、甚至是非法代孕国家寻求代孕，无形中增加了代孕行为的风险。</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;">国内的代孕中介透露，资金不充足的男同志都会前往费用较低廉的乌克兰或俄罗斯寻求代孕，但是却最终遇到很多麻烦，「乌克兰和俄罗斯对同性恋是不友好的」。同时两国法律都有规定，「代孕必须是合法夫妻，需要生殖方面的辅助治疗，才能申请代孕」。</span></p><p style="margin-bottom: 20px; line-height: 2em;"><strong><span style="font-size: 16px;">同志收养孤儿院的孩子，可行吗？</span></strong></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;">在中国，代孕合法化仍有很大的努力空间，有些同志家庭会考虑以收养方式孕育下一代？「血缘」是很重要的考量吗？「我完全不在意这个小孩到底是怎么来的，我只是希望，我想要有一个家。」这不是一个人的想法。</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;">《中华人民共和国民法典》第一千零九十八条</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;"> 收养人应当同时具备下列条件：</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;"> （一）无子女或者只有一名子女；</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;"> （二）有抚养、教育和保护被收养人的能力；</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;"> （三）未患有在医学上认为不应当收养子女的疾病；</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;"> （四）无不利于被收养人健康成长的违法犯罪记录；</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;"> （五）年满三十周岁。</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;">《中华人民共和国民法典》第一千一百零二条</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;"> 无配偶者收养异性子女的，收养人与被收养人的年龄应当相差四十周岁以上。</span></p><p style="margin-bottom: 20px; line-height: 2em;"><span style="font-size: 16px;">最后一条表明，单身人士可以领养孩子，但是只能收养与自己同性别的孩子，但是对年龄要求却高了很多，收养人至少也得四十岁以上了。</span></p><p><br/></p><link rel="stylesheet" href="//www.lotusivf.com/source/plugin/wcn_editor/public/wcn_editor_fit.css?v134_W6C" id="wcn_editor_css"/>
